1. Scope
This notice explains the terms of use for the intellectual property elements published on the desenix.com website under the DESENIX brand.
DESENIX is a brand operated by 9 Dijital Baskı San. Tic. Ltd. Şti..
The content on the site may be protected, subject to the rights of the relevant right holder, under Law No. 5846 on Intellectual and Artistic Works, Law No. 6769 on Industrial Property, and other applicable legislation.
2. Content Belonging to DESENIX
Unless explicitly stated otherwise, the rights to the following content — created by DESENIX or for which usage rights have been transferred to DESENIX — belong to 9 Dijital Baskı San. Tic. Ltd. Şti.:
- Website design, page layouts, and interface components
- Corporate texts and descriptions
- Original graphics and illustrations
- Product and production photographs
- Catalog and promotional materials, videos, animations, and presentations
- Original patterns, pattern collections, and category images belonging to DESENIX
- Product Design Studio interface
- Software components and original source code
- Database structure and original content curation
Content belonging to third parties or users is not covered by this scope.
3. Pattern Archive
Patterns in the DESENIX Pattern Archive may have been created by DESENIX, licensed for use or publication from designers, obtained from a licensed source, or added to the archive with the user's explicit consent.
The intellectual property rights of each pattern belong to DESENIX or the relevant right holder.
Viewing a pattern on the site, adding it to favorites, obtaining its design code, or purchasing fabric printed with the pattern does not mean the pattern's intellectual property rights are transferred to the BUYER.
The customer may only use the printed product they purchased in a manner consistent with the purpose of their order.
Reselling the pattern's digital file, publishing it on other platforms, reproducing it, or distributing it to third parties requires separate written permission.
4. Content Uploaded by Users
The intellectual property rights to patterns, logos, photographs, drawings, sketches, technical files, text, and reference images uploaded by users to DESENIX belong to the user or the relevant right holder.
The user acknowledges that they hold the right to use, print, and submit the content they upload to DESENIX.
For content uploaded by the user, DESENIX is granted a limited license solely for the purpose of carrying out the following:
- Reviewing the file and preparing it for printing
- Preparing a sample
- Producing the order and retaining the production file
- Generating a design code and allowing the user to reorder
This limited license does not mean ownership of the design is transferred to DESENIX.
5. Design Confidentiality
Custom designs uploaded by the user are used solely within the scope of that user's account, order, and production processes.
These designs are not published in the DESENIX Pattern Archive or any publicly accessible area without the user's separate, explicit consent. Publishing a design in the archive is not a requirement for placing an order.
Publication consent given by the user does not mean ownership of the design is transferred to DESENIX. Any transfer of rights requires a separate, written rights-transfer agreement.
6. Permitted Uses
Users may view the site for personal or commercial research purposes, share links to publicly available product and pattern pages, and use the printed products they purchase in accordance with their intended use.
Subject to legal exceptions and explicitly granted permissions, the following uses of the content are prohibited:
- Unauthorized copying, digital downloading, or republishing
- Uploading to another website
- Selling or licensing
- Modifying or creating derivative works
- Reproducing for the purpose of creating a new pattern
- Using in commercial catalogs or preparing for printing
- Automated scanning, scraping, or compiling into a dataset
- Using to train an artificial intelligence model
- Presenting as if affiliated with the DESENIX brand
Commercial use without written permission may constitute a rights infringement.
7. Pattern Codes
Pattern codes generated by DESENIX are system identifiers used to manage ordering and reordering processes.
A user knowing or sharing a pattern code does not mean any of the following:
- That the pattern file has been transferred to the user
- That the pattern may be reproduced
- That the pattern may be printed by another manufacturer
- That the pattern may be commercially resold
8. Brand and Corporate Identity
The DESENIX name, logo, emblems, corporate color system, slogans, domain name, and distinctive brand elements belong to 9 Dijital Baskı San. Tic. Ltd. Şti. or the relevant right holder.
Without written permission, these elements may not be used on other products or services, in advertising and promotions, in domain names, on social media accounts, in marketplace stores, or in imitation or misleading corporate identities.
Having a business relationship with DESENIX does not grant authorization to use the brand.
9. Third-Party Content
The site may contain licensed images, fonts, software libraries, designs, or other content belonging to other right holders. The rights to this content belong to the relevant right holders and are subject to their own license terms.
The presence of third-party content on the DESENIX site does not mean this content may be freely used.
10. Copyright Infringement Notice
If you believe that content published on the site infringes your intellectual property rights, you may contact [email protected].
Your submission should include the following information:
- The name, surname or title, and contact information of the applicant
- A description or documentation demonstrating right-holder status
- A clear description of the content believed to infringe and a link to the relevant page
- The action requested
- A statement affirming the accuracy of the declaration
Additional information and documentation may be requested for incomplete or unverifiable submissions.
Valid submissions will be reviewed and, if deemed necessary, the relevant content may be temporarily removed, access may be restricted, or an explanation may be requested from the parties involved.
11. In the Event of Infringement
In the event of unauthorized use of content belonging to DESENIX or the relevant right holder:
- Removal of the content or cessation of use may be requested
- An application may be made to have access blocked
- Compensation for damages incurred may be sought
- Legal or criminal remedies may be pursued under applicable legislation
12. Permission and License Requests
Requests for permission to use images, patterns, catalogs, text, or other content belonging to DESENIX may be submitted in writing to [email protected].
The submission should specify the content intended for use, the purpose of use, the medium of publication, the duration, the country, and the commercial scope.
The absence of written permission does not mean the request has been approved.
13. Updates
This notice may be updated in line with changes to DESENIX's content structure, licensing relationships, or applicable legislation. The current version and update date are shown automatically at the bottom of the page.
